Asylum is a crucial aspect of U.S. immigration law. It is reserved for people seeking to escape violence or persecution in their home country. If you have a well-founded fear, the team at Stump Law will fight to demonstrate your eligibility and provide the safety you seek.

Asylum Eligibility

Having a well-founded fear of prosecution is not enough to be eligible for asylum. You must also meet the following conditions:

  • Apply for asylum at the port of entry i.e. airport, border crossing, or seaport
  • Submit an asylum application to either the U.S. Citizenship and Immigration Service or the Executive Office of Immigration Review within a year of entry into the country
  • Demonstrate that you are a refugee as defined by U.S. immigration law
  • Demonstrate you would face persecution in your home country based on your race, religion, political opinion, nationality, and membership in particular social groups

Furthermore, the persecution must have been imposed by the government from the country you are running from or someone the government is unable or unwilling to control.
